iPhone Pocket Warranty Program

We, Issey Miyake Inc., provides a Product Warranty Program (the “Service”) for the product “iPhone Pocket” (the “Product”) manufactured by us and exclusively sold by Apple Inc. (“Apple”). The Service is provided in accordance with these terms and conditions hereunder (the “Terms”).

In these Terms, “we,” “us,” and “our” refer to Issey Miyake Inc., and “you” and “your” refer to the customer who purchased the Product.

This Service is provided as a voluntary manufacturer warranty and offers additional benefits and does not replace any statutory rights you may have under applicable consumer law.

 

1.    Warranty Period

(1)  The warranty period for the Service is one (1) year from the date you purchased the Product (the “Warranty Period”).

(2)  The start date of the Warranty Period is determined by the purchase date shown on your receipt, invoice, delivery note, or similar document presented at purchase.

(3)  The Warranty Period for this Service does not limit any rights you may have under applicable consumer law.

 

2.    Service Coverage

(1)     During the Warranty Period, if a defect occurs in the Product due to a Material or Manufacturing Defect under normal use in accordance with the handling instructions, we shall, at our discretion and free of charge, repair the Product or replace it with an equivalent product (the "Warranty Service") in accordance with these Terms.

(2)     Material or Manufacturing Defects” as used here refers to defects existing in the Product at the time of purchase, such as (by way of example):

·         Significant unraveling of stitching or thread breakage;

·         Structural defects in handles that cannot withstand normal use.

(3)     Products replaced under the Warranty Service may be collected by us as our property, at our discretion.

(4)     Our liability under this Service is limited to the Warranty Service described above; no monetary refunds will be provided.

 

3.    How to Use This Service

(1)     If you wish to use this Service, you must contact the Apple Store where you purchased the Productapple.com store support, or Apple Retail Customer Care at 1-800-MY-APPLE (the “Store of Purchase”) directly. Under our arrangement with Apple, Apple functions as the sole authorized initial point of contact for the Service.

(2)     If you contact any of our stores, customer service departments, or other points of contact other than the Store of Purchase regarding this Service, we will be unable to process your request. In such cases, we kindly ask for your understanding that we will direct you to the Store of Purchase for the Service.

(3)     When using this Service, you must present to us and/or Apple reasonable proof verifying the purchase fact and date (e.g., an original store receipt or an online store purchase confirmation email provided by the Store of Purchase). Even if you cannot present such proof, we may provide the Service if we can verify the purchase fact and date through other reasonable means at our discretion. However, the final decision on Service provision rests solely with us.

 

4.    Cases Where This Service Does Not Apply (Exclusions)

Even during the Warranty Period, we may decline eligibility for the Service, at our discretion, if any of the following apply:

a)       No acceptable proof of the purchase fact and purchase date is presented as required under Section 3(3), or the documents are found to be altered, or there is a reasonable suspicion of alteration.

b)      The reported issue is normal wear and tear or natural aging (including, without limitation, fabric abrasion, minor scratches, fading, natural changes in material texture, or stains).

c)       The reported issue is reasonably determined to be caused by external physical force or improper handling after purchase (including dropping, collision or other external impact; storing excessively heavy items; cuts or tears from sharp objects; stains from liquids or prolonged exposure to moisture; improper cleaning; or long-term storage in direct sunlight).

d)      The reported issue is reasonably determined to have been caused by force majeure or other events beyond our reasonable control (including but not limited to earthquake, lightning, flood, typhoon, or fire), or by other external factors.

e)       The reported issue is reasonably determined to be caused by repairs or modifications performed by anyone other than us.

f)        The reported issue is reasonably determined to be caused by other reasons not attributable to us.

 

5.    Repairs After the Warranty Period Expires

For Products whose Warranty Period has expired, repairs may be available for a fee upon your request. Please first consult your Store of Purchase regarding the feasibility and cost of such repairs.

 

6.    Availability of Repair Materials

We will endeavor to retain materials necessary for repairing the Product for a reasonable period after its production has ceased. However, please understand that we may be unable to perform repairs due to reasons such as the unavailability of such materials.

 

7.    Disclaimer

We shall not be liable for any direct or indirect damages (including but not limited to loss or damage to items stored inside) arising from a Product defect or its use, except as provided in these Terms, provided, however, that this exclusion does not apply where such damages result from our intentional acts or gross negligence, or to the extent such exclusion is not permitted by applicable laws.

 

8.    Updates to Terms

We may update these Terms from time to time. Any modifications shall apply only to Products purchased on or after the effective date of such modifications. Unless otherwise required by applicable law, the version in effect at the time you purchased your Product will continue to apply to this Service for that Product. Any modifications will not shorten your existing Warranty Period.
